This Search App End User License Agreement (“EULA” or “Agreement“) is a legal contract between Fire Arcade (“Company,” “us,” or “we”), the owner of various browser add-on extensions or other search software and mobile applications (“Search App”), and the user of such Search App and Services (“you” or “user”).

 

This EULA outlines the terms and conditions for using the Search App and its related features. We may collect and process certain information regarding your use of the Search App and Services. Please review our Privacy Policy before using the Search App.

 

By installing and using the Search App, you confirm that you have read, understood, and agree to this EULA. You explicitly agree to use the Search App in accordance with this EULA and to comply with all applicable laws and regulations. If you do not agree to these terms, do not install or use the Search App and uninstall it if applicable.

 

Search App Services

 

The Search App enhances your search experience by modifying browser and search settings, providing direct web search, and displaying relevant advertisements based on your preferences. We may add, modify, suspend, terminate, or discontinue any Services at our discretion. If changes affect existing services, we will provide prior written notice, allowing you to terminate the service as outlined in the “Term and Termination” section. Current subscriptions to our Premium Plans will not be affected.

 

You acknowledge that search queries, offers, and other information shown within our Search App are provided by third parties and are beyond our control.

 

Grant of License and Proprietary Rights

 

This EULA grants you a limited, non-exclusive, non-transferable, non-sub-licensable, and revocable license to download and use the Search App (“License”). This License is for your non-commercial, personal use and is subject to compliance with this EULA. All other rights are reserved by the Company, which retains sole ownership of the Search App.

 

All intellectual property rights in the Search App, including tradenames, trademarks, logos, modifications, upgrades, derivative works, know-how, technology, ideas, and inventions, are the exclusive property of the Company and its licensors.

 

User Representations and Warranties

 

You are solely responsible for any download, installation, use, or access to our Search App or Services. You warrant that your use of our Search App or Services will not involve prohibited conduct, such as unlawful activities, modifying legal notices, interfering with networks, or using malicious codes. The Search App and Services must be used in accordance with this EULA.

 

By using our Search App, you agree not to:

– Modify or bypass any feature of the Search App.

– Interfere with security features or degrade performance.

– Use malicious codes or automated means to access the Search App.

– Copy, sell, lease, sublicense, share, or distribute the Search App or License.

– Reverse engineer or attempt to derive the source code.

– Use the Search App fraudulently or unlawfully.

– Assert proprietary rights to the Search App or its content.

– Violate any term of this Agreement.

 

Breaching this EULA may result in suspension or termination of your access to the Search App and may lead to civil and criminal liability.

 

Third-Party Content

 

The Search App includes content from third parties, such as advertisements and search results, which are not under our control. You are responsible for reviewing the terms and policies of third-party content. We do not warrant or guarantee third-party content and are not responsible for it. The inclusion of such content does not constitute an endorsement by us.

 

Updates and Upgrades

 

We may update or upgrade the Search App and Services without prior notice. By installing the Search App, you agree to automatic updates. We have no obligation to provide upgrades or updates and are not liable for any resulting damages.

 

Disclaimer

 

The Search App and Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Search App will be free of viruses or errors. Your use of the Search App is at your own risk. We are not responsible for third-party content.

 

Limitation of Liability

 

To the fullest extent permitted by law, the Company and its affiliates shall not be liable for any indirect, incidental, consequential, or exemplary damages arising from the use or inability to use the Search App. The Company’s liability shall not exceed the amount paid by you for the Search App or five dollars ($5), whichever is less.

 

Indemnification

 

You agree to defend, indemnify, and hold harmless the Company and its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Search App, breach of this EULA, infringement of third-party rights, or violation of laws.

 

Term and Termination

 

Either party may terminate this EULA at any time. You may uninstall the Search App using the standard uninstall procedure in your device settings. Upon termination, the License will automatically terminate. The Company may cease operation of the Search App at any time without liability. Provisions that should survive termination will remain in effect.

 

Privacy

 

We care about your privacy. You may be asked to provide personal information necessary for the operability of our Search App or Services. By using the Search App, you agree to the collection, transmission, storage, and processing of such information as outlined in our Privacy Policy.

 

Amendments of This Agreement

 

We may amend this EULA at our discretion. The date of the most recent EULA will be indicated in the “Last Modified” date. Changes will be effective upon publication, and your continued use will constitute acceptance of the revised EULA.

 

General Terms

 

*Governing Law:  This EULA is governed by the laws of England and Wales. Any disputes will be resolved in the competent courts in the United Kingdom. Claims must be filed within twelve months or be permanently barred.

 

*Force Majeure:  The Company will not be in breach if unable to provide the Search App or Services due to events beyond its control, such as natural disasters, labor disputes, or government regulations.

 

*Entire Agreement:  This EULA constitutes the entire agreement between the parties. If any part is found unenforceable, the remaining provisions remain valid.

 

*Assignment:  You may not assign this EULA or any rights herein. The Company reserves the right to assign this EULA and delegate its obligations.

 

*Waiver: Failure to act on a breach does not waive the right to act on future breaches.
